Access to courts in Massachusetts is currently restricted to protect the health and safety of the community. This has resulted in delays that could extend family law and other legal cases well into the future. Such delays are likely to take an emotional and financial toll on the parties involved.

However, there are effective tools that can be used outside of court to keep the process moving for people who need to resolve conflicts in a timely manner.

Options for dispute resolution in this time of uncertainty

Mediation is a method of conflict resolution that can help minimize costs and delays. Because mediation is an out-of-court process, you don’t have to wait for access to the court to proceed with dispute resolution regarding divorce, child custody or other legal matters.

With mediation, you and the other party can take an active role in resolving the dispute. This is different than courtroom proceedings, which are very formal and often lead to results that neither party really wants. By contrast, both parties have a voice in the mediation process. This generally leads to agreeable results for both parties.

Mediation can be done safely through video conference

You can work to resolve conflicts through mediation without leaving the safety of your home. That means you don’t have to wait for access to the court. You can simply agree on a time to meet remotely — via Zoom or other conferencing service — and go from there.
